These Terms and Conditions (βTermsβ) govern your use of the Certyme service.
By accessing or using the Service, you agree to these Terms.
1. Service Description
Certyme provides AI-supported image authenticity analysis and certification services.
Users purchase digital tokens which grant access to image analysis services.
Tokens represent digital usage rights only and have no monetary value.
2. User Accounts
An account is required to use the Service.
Users must provide accurate and complete information and are responsible for maintaining the confidentiality of their login credentials.
3. Token Purchases & Usage
Tokens:
β’ grant access to digital analysis services
β’ are consumed when a scan is performed
β’ are non-transferable unless explicitly permitted
β’ are non-refundable once used
Certyme reserves the right to modify token pricing, usage rules, and service parameters at any time.
Tokens may expire only where required for operational, legal, or security reasons.
The number of tokens required to perform an analysis may vary depending on the complexity of the service, the specific AI model selected, or the depth of the analysis requested. The applicable “token price” for each specific service will be displayed clearly within the user interface prior to initiation.
A token is considered “consumed” as soon as the user confirms the start of the analysis and the technical process is initiated. Once the service has been performed and the results or certificate have been generated, the transaction is final. Due to the nature of digital services, consumed tokens are non-refundable unless the service fails to deliver a result due to a technical error on our part.
4. Digital Service & Waiver of Withdrawal Right
By completing a purchase, you expressly agree that:
β’ the execution of the digital service begins immediately after purchase, and
β’ you acknowledge that you lose your statutory right of withdrawal once the service begins.
5. Payments
Payments are processed through third-party payment providers, including Stripe, PayPal, and WooCommerce Payments.
Certyme does not store full payment details.
6. AI Analysis & Disclaimer
The Service uses artificial intelligence to analyze images.
By using the Service, you acknowledge and agree that:
β’ results are probabilistic and not guaranteed to be accurate
β’ the analysis constitutes an automated technical assessment
β’ certificates represent an AI-based evaluation and not definitive proof
β’ the Service is provided for informational and verification support purposes only
β’ Certyme is not liable for decisions made based on analysis results
The Service does not replace professional verification, forensic analysis, or legal authentication.
7. Third-Party Services
The Service relies on external providers.
Certyme is not responsible for:
β’ availability of third-party services
β’ processing delays
β’ external service errors
β’ data handling by third parties
8. User Content & Grant of Rights
8.1 By uploading an image, you represent and warrant that you own all necessary copyrights and usage rights, or have obtained explicit permission from the rightsholder, to have the image analyzed by our Service.
8.2 You do not transfer ownership of your images to Certyme. However, you grant Certyme a non-exclusive, worldwide, royalty-free license to process, transmit, and analyze the uploaded image for the sole purpose of providing the service and generating the authenticity certificate.
8.3 Indemnification:
You agree to indemnify and hold Certyme harmless from any third-party claims, including legal fees, arising from a breach of image rights or copyrights caused by your upload.
9. Service Availability
We strive to provide continuous availability but do not guarantee uninterrupted service.
Maintenance, technical issues, security measures, or third-party outages may affect availability.
We reserve the right to modify, suspend, or discontinue parts of the Service at any time for operational, security, or legal reasons.
10. Limitation of Liability
To the fullest extent permitted by law:
β’ Certyme shall not be liable for indirect or consequential damages
β’ liability is limited to the total amount paid by the user
β’ Certyme is not liable for losses resulting from reliance on AI-generated results
β’ Certyme is not responsible for data loss outside its control
Users are solely responsible for how they interpret and use analysis results.
Nothing in these Terms excludes liability where prohibited by law.
11. Intellectual Property
All platform content, software, branding, and technology remain the property of Certyme.
Users retain rights to their uploaded images.
12. Termination
Certyme may suspend or terminate accounts in case of violations or misuse.
Users may terminate their account at any time.
13. Governing Law
These Terms are governed by the laws of Germany.
